In response to the figures, a spokesperson for North Tyneside Council said: “Noise complaints in North Tyneside have fallen to their lowest level in five years. Every complaint we receive is fully investigated by our Environmental Health team and, where a statutory nuisance exists, we act – including the use of abatement notices where necessary. We encourage residents to report concerns quickly and easily through our online reporting system.”
For noise to be classed as a statutory nuisance, it must, according to the Department for Environment, Food & Rural Affairs: “unreasonably and substantially interfere with the use or enjoyment of a home or other premises.” Failing that, a nuisance must “injure health or be likely to injure health.”
According to the GOV.UK website, if someone does not comply with an abatement notice after being served one they can be prosecuted and fined with the possibility of further fines for each day they fail to comply. Abatement notices can also be issued for nuisance smoke, smells, artificial light, piling rubbish, or insect infestations from industrial or business premises.
